By accessing or using FSBO Deal Tracker ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Service Description

FSBO Deal Tracker is a real estate investment intelligence platform that provides:

• Automated For Sale By Owner (FSBO) listing aggregation from public sources
• Distress scoring and keyword analysis
• AI-powered photo analysis for property condition assessment
• Price tracking and price-cut alerts
• Geographic risk assessment (flood zones, environmental factors)
• NDVI vegetation analysis from satellite imagery
• Deal pipeline and CRM-style tracking tools

3. Disclaimer — Not an Appraisal

FSBO Deal Tracker provides data aggregation and scoring estimates only. These are not appraisals, property valuations, or professional real estate advice. Distress scores, AI analyses, and data from third-party sources are informational and should not be the sole basis for any investment, purchase, or financial decision. Always conduct independent due diligence and consult licensed professionals before making real estate decisions.

4. User Accounts

You are responsible for maintaining the security of your account credentials and for all activity under your account. You agree to provide accurate information during registration. We reserve the right to suspend or terminate accounts that violate these terms.

5. Subscription & Payments

FSBO Deal Tracker offers free and paid subscription tiers. Paid subscriptions are billed monthly through our payment processor (Helcim). By subscribing, you authorize recurring charges to your payment method.

• Subscriptions renew automatically each billing cycle unless cancelled
• Cancellation takes effect at the end of the current billing period
• No prorated refunds for partial months
• We reserve the right to change pricing with 30 days notice

6. Refund Policy

Subscriptions are generally non-refundable. We may, at our sole discretion, provide refunds for:

• Technical errors that prevented access to paid features for an extended period
• Duplicate charges caused by system errors

7. Acceptable Use

You agree not to:

• Use the Service for any illegal purpose or to violate any laws
• Scrape, crawl, or use automated means to access the Service beyond normal API usage
• Resell, redistribute, or sublicense Service data without authorization
• Attempt to circumvent rate limits, access controls, or security measures
• Provide false information during registration or use
• Interfere with or disrupt the Service or its infrastructure

8. Intellectual Property

All content, design, and functionality of FSBO Deal Tracker is protected by copyright and other intellectual property laws. You may use data obtained through the Service for your personal or business purposes, but may not redistribute, resell, or create derivative products from our aggregated data, scoring algorithms, or analyses.

9. Third-Party Data

FSBO Deal Tracker aggregates data from public sources and third-party providers. We make no warranties regarding the accuracy, completeness, or reliability of third-party data. Listing data, property details, and environmental information may contain errors or be outdated.

10. Limitation of Liability

To the maximum extent permitted by law, FSBO Deal Tracker and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability for any claims shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless FSBO Deal Tracker and its operators from any claims, losses, or damages arising from your use of the Service, violation of these terms, or infringement of any third-party rights.

12. Service Availability

We strive for high availability but do not guarantee uninterrupted access. We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with reasonable notice when practicable.

13. Changes to Terms

We may update these Terms of Service at any time. Material changes will be communicated via email or a notice within the platform. Continued use after changes constitutes acceptance of the updated terms.

14. Governing Law

These terms are governed by the laws of the State of Ohio, United States, without regard to conflict of law provisions.
